Sometimes your Will requirements are more complicated, because of your family situation, the type of assets you own, or both. In these cases, you may need a Complex Will to make sure your wishes are properly carried out and your loved ones are protected.

When might you need a Complex Will?

Here are some of the most common situations we see:

  • Foreign assets – If you own property or assets outside the UK, you’ll need to think about how your Will interacts with local inheritance laws. Some countries have strict rules about who inherits, so specialist advice may be required.

  • Business assets – If you own a business, you’ll want to decide what should happen to it when you die.

  • Care home fees – If you’re worried about care fees reducing the inheritance for your family, there are steps we can take to help protect your assets.

  • Gifts with conditions – Sometimes you may want to leave a gift but attach certain conditions (for example, a child only receiving money once they reach a certain age). This usually requires a trust, and the right type of trust will depend on your circumstances.

  • Tax planning – If you want advice on inheritance tax or how best to use tax allowances, this goes beyond a Simple Will. We’ll need to understand your situation in detail to give the right advice.

  • Rights to live in your home – You may want someone to be able to live in your property after your death without actually inheriting it. This could be set up through a right to occupy or a life interest trust, depending on whether the right should end after a fixed time, remarriage, or their own death.

Do you need a Complex Will?

If any of the above apply to you or if you’re unsure whether your situation is more complex, it’s best to get advice.

We’ll talk through your circumstances, explain your options clearly, and help you put the right Will in place to give you peace of mind.
