Over the weekend, the Government announced that the right to erect single-storey rear extensions in England, up to a maximum depth of 8 metres (or 6 metres for attached houses), has been made permanent.

You will still require full planning permission for larger extensions. We recommend you consult with a planning law expert first. Attwells Solicitors are property and planning law experts, we offer planning advice from ÂŁ250 plus VAT.

Although this news was announced over the weekend, the right was originally introduced by the government in 2013 as a temporary rule; since that time over 100,000 people have benefited.

Building Extensions

Those planning to build an extension within the prescribed size limits are required to submit plans to the local Council with details of their proposal, and the Council will notify neighbours. Subject to no objections being received from neighbours, the proposal can proceed.

If neighbours do raise concerns, the Council will consider if the extension is likely to harm the amenity (i.e. privacy/light) of the neighbours, and may refuse the plans on this basis.
